The Supremes will be unanimous in denying that a former president has legal immunity after leaving office. And that there was no double jeopardy, since he hasn't been criminally tried for anything about 1/6 before.

    I am watching Lawrence O’Donnell now. 25 years ago Justice Kavanaugh wrote an opinion that directly contradicts Trump’s hope and his lawyers' arguments on immunity and double jeopardy.

    After falsely pretending that Trump is being prosecuted like any other defendant, Biden's henchman Jack Smith just proved what a liar he is. On Monday Smith filed an unusual emergency appeal directly to the U.S. Supreme Court, which would be laughed out of court if Smith were treated like any other litigant there.

    While the 3-justice liberal wing of the Supreme Court will surely grant whatever Smith wants, and perhaps Roberts will too, that totals only 4 votes when he needs 5 to obtain fast-track review in bypass of the intermediate appellate court. Smith appears to be one vote short, which liberals recognize by baselessly demanding recusal of conservative Justice Thomas.

    Ponderer, I'm not worried about the vote on this. I'm just curious as to how many, if any, would actually vote to give a president that kind of power especially as, I hope, most Americans are beginning to see that we need to start limiting the president and Supreme Court's power. It's gonna' be interesting.

    Legal pundit Andrew Weissmann pointed out an inconsistency in Donald Trump’s arguments of presidential immunity. Trump argues that as a one-time president he should not be subjected to the intrusive and time-consuming aspects of a criminal trial, which interferes with his political campaign. However, that does not square with his delaying tactics and his numerous and frivolous appeals which consume time and overshadow his political campaign.

    I will add my own thought: when has an innocent person ever been so insistent on delaying the wheels of justice and the opportunity to be found not guilty in a court of law?

    This decision is purely a matter of answering the question of where the appropriate boundaries are in the Constitution's separation of powers. This GOP nominees are Originalists. That's all that will matter to them, either way.

    Unlike po, I ain't a law school professor and a former Supreme Court clerk, however, my sense is that Trump's lawyers are merely throwing up Hail Marys which have little chance of scoring.

    I can't see that my Legal Goobers have weighed in on this specifically but...

    ...#3, Andy McCarthy, actually predicts that Trump will be in prison on election day...

    ...and, #1 Alan Dershowitz, continues to predict that Trump will be convicted on the DC charges and that conviction will be overturned after the election.

    Curt, In my opinion of course Trump is right. His indictment and trial will interfere with his campaign. I doubt there are many who could possibly argue against that.

    When a person is indicted for a crime it’s going to interfere with virtually every aspect of their life including running for a public office.

    There is no precedence or law that I've ever heard of that would make a former president immune from or give him the power or the right to delay a criminal trial any more than any other private citizen. Whether or not he has chosen to run for public office again or not is irrelevant. An ex-president is still a private citizen just like you or me.

    Even if the court chooses not to take the case which I guess could happen...I doubt Trump could delay the trial until after the election, which is as we all know, exactly what he’s trying to do.

    When a person is indicted...

    Apparently, when a person is indicted, it's as if s/he is given a bag of gold. When these indictments began to pile up, Trump had a slight lead over Ron DeSantis. Now, his lead is historic and insurmountable...over the whole GOP primary field.

    ...AND, stunningly, he has caught and passed the Doddering Old Fool in head to head match up as well.

    I think most people assumed that the indictment would impact Trump's candidacy...just not as it has.

    Exactly. Indictments and trials would get in the way of anyone's professional and personal life.
    For Sherlock Holmes an indictment would be detection interference.
    For would-be parents an indictment would be conception interference.
    For wedding planners an indictment would be reception interference.
    For the sexually active an indictment would be erection interference.

    For Donald Trump, the one thing an indictment is NOT is deception interference.
